Cars with suspension modifications are not covered under the subframe agreement.

From what I've heard and read, it will really depend on the dealer. Some dealers are "cool" about mods and realize that you could always just bolt the original parts back on.

Of course, you can always just bolt on the original parts.

I think it's not under warranty, if i'm not mistaken. Correct me if I'm wrong.

I know this is tangential at best, but I used to take my modded Z4 to BMW of Fairfax and I never got any run-around for service or warranty stuff. They threw new rotors and brakes on the car for me at inspection time (I was still under the service interval) even though the car had modded suspension and oversized wheels / tires, and had fresh track time on it, including "blue" pad-worn rotors.

I know its not a subframe story, but I consider them to be a mod-friendly dealer as a result. BMW of Sterling is the exact opposite, they won't even change your oil unless you're past due. I don't have any experience with Arlington or the Maryland dealers.

I think you will have better luck if you do it yourself at an independent shop and just spend the money. The dealer, even if they "fix" your suspension, if it is under 5 inches they will fill it up with this epoxy like foam that is very hard. It's not really a "fix" more like a "mend".

The only way to really fix and ensure the problem is done and over with is if you do a subframe weld and get it to an independent shop. The deadline for getting money back is September so you still have some time and SOME members of the Bay Area forum HAVE been reimbursed for their cracks in their subframe for work done by an independent shop WITH modded cars. Good luck!
