Default Yet another check engine/02 sensor thread

Hi guys , I just picked up my 1995 Avus M3 wednesday.. When i test drove it the CEL came on... the dealer I bought it from said it was the 02 sensor + replaced it before I bought the car. (light was then off)

Well the next morning after driving 10 miles or so it came back on for a 1/2 hr then off for the final 2 hrs of my trip... in driving the last few days it has repeated the behavior... this morning it was off for 2 hrs then on for the last 30 mins of my trip, and as it sits, the code is on. I checked the code and it reads 1221 .. which I guess is the 02 sensor...
SO

is this on because they messed up the 02 install/got a faulty sensor or what? Could it be coming on because i'm getting a bad mixture? If so, what can I do?
They supposedly ran Virginia emissions on it, though the report has not shown up online so i'm not sure if they actually ran the test or just told the DMV it passed.

Sorry if this paticular problem has been discussed, I couldent find it.
