Exclamation Beware of Seller (Bimmerforums)

I'm not sure how many of you frequent bimmerforums, but when it comes to buying and selling it seems there is more to work with on that site.

That being said: (as copied from post on bimmerforums)


I am making this thread in order to save other member's the hassle of being ripped off, and how actions by users like ethirtysixmiii really hamper our community from trusting one another.

A quick synopsis:
August 22,2008: I send ethirtysixmiii an email stating I am interested in a set of 18x8 Miro style 279 wheels (LM reps). We agree on a purchase price of 600 dollars and the money is sent the next day to his paypal account.

He informs me that he is waiting for his wheels to come back from a wheel shop and it should be no more than two weeks before they come off and are shipped.He states, "ill leave the money untouched until the rims are off and shipped."


September 12,2008:
After two weeks of back and forth emails, mainly of me asking when the wheels are off, I get in contact with the seller and he notifies me that his wheels were completed but he was unhappy with the result and he states
"ill give you a full refund until hes done and then you can re-buy the wheels back from me if you want."

I agree to take this offer based on the fact that it had been nearly 3 weeks of me sending the money and not receiving the goods.

September 22,2008:
I receive half of my money back(300), and after inquiring why I didn't get the full refund he states:
"but i was giving you a partial refund, because i was supposed to get them off today, but i had issues"

As far as business practice this completely fails in the ethics department, I paid for an item and almost a month later did not receive it. On top of that, he only refunds half to ensure that I would purchase the rims when he was ready to send them holding me hostage to my purchase after his use of the rims for a month.

October 3,2008:
I receive an email stating the wheels are ready to go and could be shipped the same day if i send the 300 back that he had refunded. I agree to send the money the same day unfortunately paypal does not work on a same day basis and he does not receive that payment until 3 days later.

October 16,2008:
I inquire about a tracking number for 2 weeks and get an email stating that he had no time whatsoever to send out the rims, and that he could not find boxes to ship them in. This is 2 weeks after stating the rims are "ready to go." At this point I'm fed up with the process and ask him to return my money in it's entirety.

October 17, 2008:
He again sends back half of my money, and states that he will send the rest as soon as a check clears. He again apologizes for the transaction.

*same day* A new thread comes up with the rims for sale for 800 dollars. They are sold on the 25th of October.

I finally reached him on November 4, and he stated that he had sent back the second half of the money, which has NO separate transaction. He asks me to look into the matter, in which i did and it showed only 300 sent back on the 17th of October and no new activity. Since then the seller has disappeared without contact even though I have called and emailed him numerous times.

ethirtysixmiii Thanks again for your poor business practice, and degrading our community of enthusiasts by relinquishing the trust we have for one another to do the right thing.

Shady people, I'm sorry to hear about your bad luck..

Did you happen to paypal via CC? If so file a chargeback and file a dispute with PP (although it seems that PP just sucks when it comes to chargebacks)

Yes I did, but the seller knew the paypal system and abused it. He refunded the first 300 through paypal on the original 600 dollar transaction. When I sent him the 300 again it was a separate transaction, , he refunded it back as part of the original transaction and not the new transaction. So as far as paypal shows, my money was refunded but when you trace the money trail I am missing 300 dollars. He knew what he was doing and partially refunded me on purpose, so when he would have to refund me the rest the transaction it would show as completely refunded. This is a way of ripping people off, and we filed a claim with paypal.

In response Paypal said they do not resolve these issues, now that I have confirmed that the seller does this on purpose, we are going to retake up the issue with paypal as a loop hole in their system that allows sellers to rip off buyers. With this approach I am hoping to get my money back and if not i just want to warn the community against shady ass people like mr kuenzi.

O man that sucks.

If you go thru the courts they will subpeona PP to give u his info and then u can take him to court. It is a sucky process but I have seen it done.
