You have to first figure out how much money was made from the distribution of this album. A lawyer is not going to take the case on contingency, if the pay off is not worth it.

99% of artists will make $1-$5k on an album for sale on Itunes. Divide that by 4 or 5 band members and your Dad will be lucky to get a grand. Subtract lawyer fees and you're back to 0.
