Yep, I have put down a deposit on my E92 M3 and my Cayman R. I got my deposit back from one BMW dealer when they couldn't guarantee me an allocation for an E92 M3. I don't think either mentioned them being non-refundable. It is generally just a scare tactic if a dealer tries the non-refundable line. Heck I haven't even signed anything from the Subaru dealer. I remember the Porsche dealer asking for a really large deposit, and I said no thanks, I will do $1000.
